These Terms and Conditions apply to all orders placed on the website www.vingtneuf.ca.
By confirming your purchase, you accept these Terms and Conditions in full, without reservation.

1. Scope

Vingt-Neuf sells cosmetic and personal care products for individual use only. Products are available for sale and delivery in Canada and the United States.

2. Pricing and Currency

All prices are displayed in Canadian Dollars (CAD) by default. 

Taxes:

  • For Canadian orders: Applicable taxes (TPS/TVQ or HST) are calculated based on the shipping province. The final tax amount will be automatically added to the order total at checkout, depending on the province where the order will be shipped.

  • For U.S. orders: Sales taxes, if applicable, will be calculated by Vingt-Neuf and added to the order total at checkout, if required by the customer's shipping address. The calculation is based on the applicable tax laws of the delivery state.

Shipping costs are added at checkout unless otherwise stated in a promotional offer.

3. Accepted Payment Methods

Payments are securely processed through Shopify Payments.
We accept:

  • Credit cards (Visa, Mastercard, American Express)

  • Apple Pay / Google Pay

  • Other secure options listed at checkout

We do not accept Interac transfers, checks, cash, or bank wires.
All transactions are encrypted using SSL technology. No credit card information is stored on our servers.

4. Shipping and Fulfillment

4.1 Order Processing

Orders are processed and fulfilled by our logistics partners within 7 business days (excluding weekends and holidays).

4.2 Tracking

Once the order is shipped, customers will receive an automatic confirmation email with a tracking link.
Vingt-Neuf is not responsible for delays due to the carrier or external factors (weather, strikes, customs delays, etc.).

4.3 Customs and Import Duties

United States Customers:
All customs duties, import taxes, brokerage fees, or local charges are the exclusive responsibility of the customer.
Vingt-Neuf will not reimburse any customs fees or assume responsibility for refused shipments due to unpaid import charges.

Shipping to the United States:

  • For U.S. orders, shipping costs are a flat rate of $39.99 CAD regardless of weight, size, or quantity.

  • This fee is non-refundable, and no additional shipping charges will apply.

5. Product Use and Liability

5.1 Proper Use

Vingt-Neuf products are cosmetic in nature and not intended to diagnose, treat, cure, or prevent any disease.
They must be used as directed on the product label or packaging.
Vingt-Neuf is not responsible for any issues arising from:

  • Improper use or overuse of the product

  • Ignoring directions or safety warnings

  • Storage in poor conditions (heat, humidity, exposure to light)

5.2 Allergic Reactions

Some products contain active ingredients (such as glutathione, niacinamide, botanical extracts, etc.) that may cause skin sensitivity or allergic reactions in some individuals.
It is the customer’s responsibility to conduct a 24-hour patch test before first-time use.

Vingt-Neuf disclaims all liability for skin reactions unless directly linked to a proven product defect.

6. Returns, Claims, and Complaints

6.1 Return Policy – Final Sale

All sales of cosmetic products are final, without exception. This policy is in place for hygienic and safety reasons, in compliance with Canadian and U.S. health regulations regarding the sale of personal care items. Once a product has been opened, used, or damaged by the customer, it cannot be returned or exchanged under any circumstances.

This policy ensures the integrity and safety of all cosmetic products sold through our website. Given the nature of the items, we cannot accept returns or exchanges once the product has been opened or used, to prevent any risk of contamination or improper handling.

6.2 Claims and Complaints – Damaged or Incorrect Items

If you receive a damaged, defective, or incorrect item, please contact our customer service within 2 calendar days of receiving your order.

Process:

  1. Email: Send an email to support@vingtneuf.ca with your order number, a detailed description of the issue, and photos of the product and packaging.

  2. Response time: You will receive a response within 5 business days.

  3. If no amicable resolution is found, disputes may be submitted to the courts of Québec (Canada).

Any claim submitted after 2 days of receipt may not be accepted.

6.3 U.S. Customers – Return Shipping Costs

For customers in the United States, the return shipping costs are the customer’s responsibility, unless the product is defective or damaged during shipment, and the return is approved by Vingt-Neuf. If a claim is accepted, we may provide a prepaid return label for defective or incorrect products.

Please note that the customer must contact Vingt-Neuf customer service within 2 calendar days of receiving the order to report any issues and request a return authorization.
Once the return is approved, the return shipping costs will be provided as part of the return process for defective or incorrect products only.

Any returns requested without prior approval will not be accepted.

7. Limitation of Liability – Final Sale Acknowledgment

By purchasing and using Vingt-Neuf products, you acknowledge and agree to the following:

  • All sales of cosmetic products are final, with no returns, exchanges, or refunds, except in cases of defective or damaged items.

  • Vingt-Neuf is not responsible for any indirect, incidental, or consequential damages resulting from the use or misuse of products.

  • The total liability of Vingt-Neuf is limited to the amount paid for the defective or damaged product, in the event of a valid claim.

8. Governing Law and Jurisdiction – Canada & United States

These Terms and Conditions are governed by the laws of the Province of Québec and subject to the exclusive jurisdiction of the courts of Québec, Canada.
Any dispute shall be resolved exclusively under the jurisdiction of Québec courts, in accordance with applicable consumer protection laws.

9. Intellectual Property

All texts, visuals, brand elements, designs, product names, logos, and content on www.vingtneuf.ca are the exclusive intellectual property of Vingt-Neuf. Unauthorized use, reproduction, or distribution of any content from the website is strictly prohibited and may result in legal action.

10. Updates to Terms and Conditions

Vingt-Neuf reserves the right to modify these Terms and Conditions at any time, without prior notice. Any changes will take effect immediately upon being posted on the website. By accessing the website and making a purchase, you acknowledge and accept the Terms and Conditions in effect at the time of your visit, as well as any subsequent modifications, without reservation.

11. Final Sale Agreement

By confirming your purchase, you explicitly agree and acknowledge that all sales are final, and no returns or exchanges are accepted for cosmetic products. This policy is strictly enforced in order to protect your safety and uphold the integrity of the products.
